 An act relating to the comfortable and inviting appearance of the document formally named “The Rogers State University Student Government Statutes and Bylaws”.


BE IT ENACTED BY THE ROGERS STATE UNIVERSITY STUDENT GOVERNMENT ASSOCIATION:

 Section 1. This act shall be known as the “Good First Impressions Act of 2011”

 Section 2. AMENDATORY Statutes and Bylaws, Title One, Chapter One, and Chapter Two is amended to read as follows:

 TITLE ONE: GENERAL
Chapter One: Impeachment and Removal of RSU S.G.A. Elected Officials

SECTION 1: For the purposes of clarity and full understanding, the following definitions shall apply as relates to the process of impeachment and removal from office:

A. Impeachment: An impeachment is the prosecution, by the RSU S.G.A. before the elected Judicial Review Board of S.G.A, of any member of the Executive Committee, Student Senate, elected RSU S.G.A. official, or student club/organization as defined in Title 6 of the RSU S.G.A. Statutes and Bylaws, for willful neglect of duty, corruption in office, gross misconduct, dereliction of duty, or incompetence.

B. Articles of Impeachment: The Articles of Impeachment are the written accusation against the defendant(s), approved and adopted by the full RSU S.G.A.

C. Judicial Review Board: A group of five (5) individuals elected by the student body of Rogers State University to preside over impeachment hearings, review questions of constitutionality, conduct student trials, and submit official opinions and rulings.


 SECTION 2: Articles of Impeachment must originate in the RSU S.G.A. Senate and must state with reasonable certainty the offense in which the Officer, Senator, or student club/organization is up for impeachment, and if there be more than one offense brought against the said Officer, Senator, or student club/organization, they shall be stated separately and distinctly.

SECTION 3: Upon the adoption of the Articles of Impeachment, the Judicial Review Board shall be vested with the responsibility of convening to review the Articles of Impeachment. The Judicial Review Board shall conduct a formal hearing in which the author of the Articles of Impeachment shall serve as prosecutor.


SECTION 4: The Judicial Review Board shall elect a Chairman from within its membership.


D. The Chairman of the Judicial Review Board of S.G.A. shall appoint a Marshall and Deputy Marshall from the members of the Board. The Marshall and Deputy Marshall shall be empowered to serve all process, writs, and subpoenas issued by the Judicial Review Board, on behalf of the Prosecution in a trial of Impeachment.

E. The Chairman of the Judicial Review Board shall also appoint a Clerk from the members of the Board. The Clerk shall be responsible for taking and keeping accurate records and minutes, compiling the records and procedures of Impeachment into a Trial Journal, and recording the issuance of all summons, writs, and process.

 SECTION 5: The Judicial Review Board of S.G.A. shall be responsible for presenting the Articles of Impeachment to the Executive Committee within seven (7) days of their adoption in the organization.

SECTION 6: Every member of the Judicial Review Board of S.G.A. shall be required to attend every part of a trial adhering to Impeachment Procedures.


SECTION 7: The Judicial Review Board of S.G.A. shall meet no less than once every month during the academic year in order to review RSU S.G.A. business and minutes for the purposes of establishing validity and assuring constitutionality.


SECTION 8: The Judicial Review Board of S.G.A. shall conduct business according to the most recent edition of Robert’s Rules of Order.


SECTION 9: When the Judicial Review Board of S.G.A has concluded its case in Impeachment Procedures and the Board has exhausted all debate upon the case, the Board shall then move immediately into a separate roll call vote on each charge brought forth in the Articles of Impeachment.

F. All Board Members present and voting shall cast a vote of either "yea" for concurrence with the charge or "nay" for dissent of the charge


G. Upon the tally of the roll call, the Chairman of the Judicial Review Board shall determine the verdict.

H. Any charge not receiving the majority shall be dismissed as a not-guilty verdict. The punishment for any guilty verdict shall be removal from office.



SECTION 10: Upon completion of the voting, the Chairman of the Judicial Review Board of S.G.A. shall certify the results and affix his or her signature to the document. The certificate of results shall be included into the Trial Journal and it, along with any opinions, shall be delivered to and filed with the RSU S.G.A. Secretary, by the Clerk, immediately upon adjournment of the trial.



SECTION 11:If an office within the JRB is vacant for reason of resignation or incapacitation the President of the SGA shall have the authority to nominate a candidate to fill the position for the allotted term upon confirmation from the Senate –Added by SB3008 passed 2/18/11


Chapter One: Appropriations



 SECTION 1: The Executive offices of the RSU S.G.A. shall be appropriated at the beginning of each academic year ten percent (10%) of the gross S.G.A. annual budget. Any and all proposals regarding RSU S.G.A. Executive officers and/or their offices for less than two hundred fifty dollars ($250) shall require a simple majority vote of the Executive Committee for passage. Any and all proposals regarding RSU S.G.A. Executive officers and/or their offices for greater than two hundred fifty dollars ($250) of the monies appropriated to the Executive Committee shall require a two-thirds (2/3) vote of approval from the Executive Committee for passage.



SECTION 2: Qualifying organizations within the RSU S.G.A. shall be appropriated evenly at the beginning of the academic year twenty percent (20%) of the gross S.G.A. annual budget.


A. Qualifying organizations shall be defined as:

i. Those not in unfavorable standing as defined in Title 6 Section 6 of the RSU S.G.A. Statutes and Bylaws.

 ii. Organizations which sponsor at least one on-campus event each semester.

 iii. Organizations which participate in at least one successful fundraising event each semester.


B. New organizations shall be appropriated one hundred dollars ($100) from the remaining S.G.A. annual budget in good faith until the next appropriation of S.G.A. funds, provided they are in good standing.


C. If an organization is found to be in unfavorable standing, their appropriated funds will be frozen until they are in good standing. If they continue to be in unfavorable standing at the end of the current semester their appropriated funds shall be returned to the discretionary budget of the S.G.A.
